1. Terms of Service

These Terms of Service ("Terms") govern your access to and use of MySimpleScan.com and any related web pages, portals, tools, features, content, communications, and services (collectively, the "Platform") offered by My Simple Scan, LLC ("My Simple Scan," "we," "us," or "our"). By accessing or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

1.1 Company Information

1.2 Definitions

  • "Customer," "you," "your": the individual using the Platform.
  • "Imaging Provider": the independent third-party MRI facility that performs imaging services.
  • "Radiologist": the independent third-party licensed physician (or radiology group) that interprets imaging and produces the official radiology report.
  • "Report": the official radiology interpretation created by a Radiologist.
  • "Summary" or "Simplified Report": a patient-friendly explanation derived from the Report to improve readability and understanding; it is educational and non-diagnostic.
  • "PHI": Protected Health Information, meaning health information linked to an identifiable individual that may be regulated under HIPAA and/or other privacy laws.
  • "Services": the coordination, payment processing, scheduling facilitation, communications, and report hosting/summarization services offered through the Platform.

1.3 What the Platform Is (and Is Not)

My Simple Scan is a technology and administrative coordination platform that facilitates access to elective, cash-pay MRI screening services performed by independent Imaging Providers and interpreted by independent Radiologists.

1.3.1 Services We Provide

  • Present information about elective MRI screening options and partner facility availability.
  • Collect customer intake information needed to coordinate scheduling and fulfill the service.
  • Collect and process payment for the customer's purchase through a third-party payment processor.
  • Transmit necessary customer information to an Imaging Provider so the Imaging Provider can contact the customer and schedule the scan.
  • Receive the Radiologist's Report (the clinical interpretation) after imaging is completed and interpreted.
  • Generate a patient-friendly Summary intended to help the customer understand the Report in plain language.
  • Provide secure portal access so customers can view and download the Report and Summary.

1.3.2 Services We Do Not Provide

  • We do not perform imaging, and we do not operate as an MRI facility.
  • We do not provide medical advice, diagnosis, treatment, or clinical decision-making.
  • We do not determine medical necessity or eligibility for insurance reimbursement.
  • We do not provide emergency services or urgent clinical care.
  • We do not supervise, direct, or control clinical judgment by Imaging Providers or Radiologists.

1.4 No Medical Relationship; Third-Party Provider Responsibility

Use of the Platform does not create a physician-patient relationship (or any other clinical care relationship) between you and My Simple Scan. Any clinical relationship, if created, is between you and the Imaging Provider and/or Radiologist.

Imaging Providers and Radiologists are independent third parties. They are responsible for:

  • medical screening and safety determinations (including MRI contraindications);
  • performing the MRI scan;
  • interpreting imaging;
  • producing the official Report;
  • clinical documentation and applicable standards of care; and
  • any follow-up recommendations or communications they provide.

My Simple Scan is not responsible for acts or omissions of third parties, including medical negligence, diagnostic outcomes, or provider availability, except to the extent required by applicable law.

1.5 Eligibility and Program Restrictions

To use the Services, you must meet all of the following requirements:

  • You are at least 21 years old.
  • You are located in Texas and will be scheduled at a Texas Imaging Provider (unless we explicitly expand service areas).
  • You can legally consent to purchase and receive the Services.
  • You are seeking elective screening (not urgent or emergency evaluation).
  • You do not have known serious pre-existing conditions that make elective screening inappropriate for you.

We may decline, pause, or cancel Services if we believe the Services are inappropriate, unsafe, or non-compliant, or if required by partner facility policies.

1.6 Customer Representations and Responsibilities

By using the Platform, you represent and agree that:

  • You will provide accurate and complete information during intake, including contact and basic health/safety information.
  • You will promptly respond to scheduling outreach and follow imaging preparation instructions.
  • You will disclose MRI contraindications and safety risks (for example, implanted devices, metal fragments, claustrophobia) to the Imaging Provider when asked.
  • You will consult a licensed physician regarding results and any medical questions or follow-up care.
  • You will not use the Platform for emergency medical needs; in an emergency call 911.

1.7 Scheduling; Cancellations; No-Shows

Scheduling is performed by the Imaging Provider. Appointment availability, rescheduling rules, and facility policies are controlled by the Imaging Provider. We do not guarantee appointment dates, times, or provider availability.

Cancellations, late cancellations, and no-shows may result in:

  • loss of the appointment slot;
  • non-refundable facility charges;
  • non-refundable administrative costs; and/or
  • delays in rescheduling.

Any cancellation window, rescheduling limits, or related fees (including pass-through facility fees) may be communicated at checkout, in scheduling communications, or by the Imaging Provider, and are incorporated into these Terms by reference.

1.8 Payment Terms; Cash-Pay; Insurance/HSA/FSA Disclaimer

All Services are offered on a cash-pay basis. We do not submit insurance claims, and we do not guarantee that any insurer, HSA, or FSA administrator will reimburse you.

You are responsible for confirming eligibility for HSA/FSA reimbursement with your plan administrator and for maintaining any required documentation.

Payments may be processed by third-party payment processors. We do not store full payment card numbers on our servers when payment processors provide tokenization or hosted payment fields.

1.9 Refund Policy (Case-by-Case)

Refunds are not guaranteed. Refunds, if any, are evaluated case-by-case in our discretion, taking into account factors including:

  • Whether the scan has already been performed.
  • Whether the Radiologist has interpreted the imaging and produced the Report.
  • Whether the Imaging Provider has incurred costs or charged fees for scheduling, cancellation, or preparation.
  • Administrative work already completed (intake review, coordination, communications, portal setup).
  • Timing of cancellation relative to the scheduled appointment.
  • Suspected misuse, fraud, or violation of these Terms.

If a refund is approved, it may be full or partial and may be reduced by non-recoverable third-party costs and administrative fees. Refunds are issued to the original payment method unless prohibited by payment processor rules.

1.10 Chargebacks and Payment Disputes

If you believe you were charged in error, you agree to contact us first at support@mysimplescan.com and provide a reasonable opportunity to investigate and resolve the issue.

Initiating a chargeback without contacting us first may result in account suspension and loss of portal access while the dispute is investigated. If we successfully dispute a chargeback, you remain responsible for any amounts owed plus applicable administrative costs permitted by law.

1.11 Reports and Simplified Summaries

The Radiologist's Report is the authoritative clinical document. We may provide you with access to the Report and also generate a Simplified Report or Summary designed to translate medical terminology into more understandable language.

You acknowledge and agree that:

  • Summaries are educational and informational only and are not medical advice.
  • Summaries may simplify, omit, or reframe information to improve clarity and may not capture every clinical nuance.
  • Summaries may be created using automation or AI-assisted tools, along with human review where applicable.
  • You will not rely on a Summary as a substitute for discussion with a licensed physician.
  • You are responsible for obtaining follow-up care, further testing, and medical guidance as appropriate.

1.12 Portal Access; Data Retention

We store the Report and Summary in a secure portal for your convenience. Reports and Summaries are retained for access for 24 months from the date of upload to the portal (the "Retention Period").

You are responsible for downloading and retaining your own copies. After the Retention Period, we may delete or archive files in accordance with our retention practices and applicable law.

1.13 Communications Consent (SMS/Calls/Email)

By providing your phone number and using the Services, you consent to receive calls and text messages (including automated messages) related to:

  • scheduling and appointment coordination;
  • service updates;
  • preparation instructions;
  • portal access and report availability;
  • customer support and administrative notices.

Message and data rates may apply. You may opt out of non-essential texts by replying STOP (or using another method provided in the message), but opting out may interfere with scheduling and service delivery. We may still send essential administrative messages where permitted by law.

1.14 Acceptable Use and Prohibited Conduct

You agree not to:

  • provide false, inaccurate, or misleading information;
  • attempt unauthorized access to the Platform or its systems;
  • interfere with security features, access controls, or audit logs;
  • introduce malware, scraping, bots, or harmful code;
  • use the Platform for unlawful, abusive, or fraudulent activities;
  • copy, reverse engineer, or resell the Platform or its content without permission.

1.15 Intellectual Property

The Platform, its content, designs, workflows, trademarks, and related intellectual property are owned by My Simple Scan or its licensors and are protected by applicable laws. You are granted a limited, revocable, non-transferable license to use the Platform for your personal, non-commercial purposes in connection with the Services.

1.16 Third-Party Services and Links

The Platform may integrate with or link to third-party services (including Imaging Providers, Radiologists, payment processors, scheduling tools, and hosting vendors). My Simple Scan is not responsible for third-party content, privacy practices, policies, or services, except to the extent required by applicable law or a separate written agreement.

1.17 Disclaimer of Warranties

THE PLATFORM AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT RESULTS WILL MEET YOUR EXPECTATIONS.

1.18 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MY SIMPLE SCAN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OPPORTUNITY, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

WITHOUT LIMITING THE FOREGOING, MY SIMPLE SCAN IS NOT LIABLE FOR MEDICAL OUTCOMES, MISSED DIAGNOSES, PROVIDER NEGLIGENCE, DELAYS IN DIAGNOSIS, OR CLINICAL DECISIONS OR OMISSIONS BY IMAGING PROVIDERS OR RADIOLOGISTS.

IN ALL CASES, OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID TO US FOR THE SERVICE GIVING RISE TO THE CLAIM.

1.19 Indemnification

You agree to indemnify, defend, and hold harmless My Simple Scan and its officers, directors, employees, contractors, and affiliates from and against claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the Platform; (b) your breach of these Terms; (c) your violation of law; or (d) your dispute with a third-party provider based on your conduct.

1.20 Dispute Resolution; Arbitration; Class Action Waiver

You agree to first attempt to resolve disputes informally by contacting legal@mysimplescan.com with a description of the issue and the relief requested. If not resolved, any dispute arising out of or relating to these Terms or the Services shall be resolved by binding arbitration in Texas, except where prohibited by law.

YOU WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN ANY CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING.

1.21 Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. Where arbitration is not permitted, venue shall be in state or federal courts located in Texas.

1.22 Suspension and Termination

We may suspend or terminate access to the Platform at any time if we believe there is fraud, misuse, security risk, or a violation of these Terms. Termination does not eliminate your obligation to pay any amounts due.

1.23 Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date controls. Continued use of the Platform after changes become effective constitutes your acceptance of the revised Terms.

2. Medical, Screening, and AI Disclaimer

2.1 Not Medical Advice

Information provided through the Platform, including any Simplified Report or Summary, educational content, or communications, is for informational purposes only and does not constitute medical advice. Always consult a licensed physician regarding your health, symptoms, and test results.

2.2 No Emergency Services

The Platform is not intended for emergency or urgent conditions. If you believe you have a medical emergency, call 911 immediately.

2.3 No Physician-Patient Relationship With My Simple Scan

Your use of the Platform does not create a physician-patient relationship with My Simple Scan. Any clinical relationship is solely between you and the independent Imaging Provider and/or Radiologist.

2.4 Screening Limitations

Elective screening MRIs may produce false positives and false negatives. Results may be incomplete, may require follow-up testing, and may not identify all medical conditions. You are responsible for seeking follow-up evaluation and clinical care with your physician based on your results and circumstances.

2.5 AI/Automation Notice for Simplified Reports

Simplified Reports and Summaries may be produced using automation or AI-assisted processes intended to translate complex medical terminology into easier-to-understand language. These outputs may be simplified and may not capture every clinical nuance. The Radiologist's Report remains the authoritative clinical document. Do not use a Summary as a substitute for medical advice or professional interpretation.

2.6 Your Responsibility for Follow-Up

You acknowledge that screening results may require follow-up with your personal physician or specialist. My Simple Scan does not provide treatment or coordinate follow-up care beyond scheduling the elective screening service unless separately offered in writing.

2.7 No Guarantee of Outcomes

My Simple Scan makes no guarantees regarding medical outcomes, diagnostic accuracy, completeness of screening, or whether screening will detect any disease, infection or health related issues.
